The Supreme Judicial Court affirmed the judgment of the county court denying Petitioner’s petition for relief under Mass. Gen. Laws ch. 211, 3 without holding an evidentiary hearing. Petitioner, who was indicted on charges of murder and other crimes, moved to dismiss the indictments on the grounds that the evidence presented to the grand jury did not establish probable cause to indict and that the integrity of the grand jury proceedings was impaired. The superior court denied the motion. Petitioner then filed this petition.
